Our Firm Handles All Types of New York Personal Injury Claims

Since 1994, Bornstein & Emanuel, P.C. has been representing injury victims with compassion, skill, and determination. We understand the physical, emotional, and financial burdens facing you and can help to lift those burdens by fighting for your right to just compensation. Our personal injury attorneys have a demonstrated record of success in all types of cases, including:

Automobile Accidents

With more and more drivers on the road in the greater New York area, especially rideshare drivers, car accidents are commonplace. We have a working knowledge of the applicable no-fault insurance and negligence laws governing motor vehicle accidents and a track record of helping our clients recover significant damages.

Construction Accidents

Construction sites are inherently dangerous, but all construction workers have a right to a safe environment. Work-related injuries are generally covered by workers’ compensation insurance, but when a construction accident is the result of third-party negligence, it may be possible to pursue an injury claim. Our attorneys regularly handle third-party claims against negligent site owners, general and subcontractors, architects and engineers, machinery or equipment manufacturers, and insurers.

Nursing Home Negligence/Elder Abuse

Elders are the most vulnerable members of our society and often become victims of nursing home neglect and abuse resulting in falls, pressure sores, malnutrition and dehydration, and serious injuries. Nursing home patients suffering from Alzheimer’s disease or dementia who are poorly supervised are also at risk of wandering away from the facility, referred to as “elopement.” and being seriously or fatally injured. Our firm is dedicated to helping families fight back against nursing home neglect and elder abuse.

Premises Liability

All property owners in New York — private, commercial, and public — are required to maintain their property and provide a safe environment to visitors, guests, and passersby and can be held liable for accidents resulting in injuries. We are highly experienced in handling premises liability claims arising from slip and fall accidents, dog bites, elevator accidents, explosions and fires, exposure to hazardous substances (e.g. mold, fumes), and assaults due to negligent security.

Wrongful Death

Losing a loved one is never easy, but if another party’s negligence was the cause of death, surviving family members can seek justice through a wrongful death lawsuit. We understand the delicate nature of wrongful death suits and work to resolve these claims in a timely and sensitive manner.

At Bornstein & Emanuel, P.C., our personal injury practice also encompasses claims arising from:

Regardless of the type of accident or negligent conduct that caused your injuries, trust our legal team to fight for the maximum compensation you deserve.

How much is my personal injury claim worth?

No two injury claims are the same, and the damages you can recover depend on factors such as the type of accident, the degree of your injuries, and the extent of your liability. The best way to protect your rights is to have an aggressive personal injury attorney at your side. That’s where Bornstein & Emanuel, P.C. comes in. We will fight to help you obtain compensation that includes both economic and noneconomic damages, such as:

  • Medical treatment, rehabilitative care
  • Lost income (present and future)
  • Pain and suffering
  • Emotional distress
  • Permanent disability
  • Loss of enjoyment of life

If you have tragically lost a loved one in a wrongful death, we will fight to help you obtain just compensation for final medical costs, funeral costs, and loss of financial and emotional support.

Given the challenges of navigating the system after being seriously injured or losing a loved one, it is wise to have the compassionate, efficient representation Bornstein & Emanuel, P.C. provides.

What Else You Need to Know About New York Personal Injury Claims

It is important to note that the rules of comparative negligence apply to personal injury claims in New York. In short, you can still recover if your actions contributed to the accident in any way, but your final award will be reduced by the percentage of fault assigned to you by an insurance adjuster or the court.

For example, if you were injured in a car accident with a distracted driver but you made an improper turn, you may be found to be 10 percent at fault. If the amount of your damages is assessed at $100,000, then the amount of your reward will be reduced by 10 percent to $90,000.

This is another good reason to work with an experienced personal injury attorney, one who knows how to protect you from liability and maximize the value of your claim.

Finally, you must act quickly because the statute of limitations generally requires you to file an injury claim within two years of the date of your accident or injury. The sooner you contact our office, the sooner we can start working on your case.
