Elder Abuse and Neglect – Nursing Home, Home Care and Hospital Liability

It is unfortunate that our elderly loved ones can find themselves at the mercy of neglectful or abusive caregivers. Our attorneys have experience handling lawsuits against nursing homes, hospitals and home care agencies on behalf of elderly individuals who have suffered indignities, injuries and death as a result of neglect or mistreatment.

Sadly, elder abuse and neglect often go undetected until some serious injury or even death results.  Elderly individuals may be suffering from Alzheimer’s disease or dementia which can deprive them of the ability to communicate that they are being neglected or mistreated.  Even when mentally impaired individuals do complain about abuse or neglect, they are not always taken seriously.  In some situations, elderly individuals may be too weak, too ill or too afraid of retaliation by their caregivers to seek help.  For these and other reasons, our elderly citizens may be at risk for neglect or abuse in their living situations. 

We suggest that family members and friends learn to recognize the signs of elder abuse and neglect.  Some common situations that may occur in facilities or in a home care setting are described below:

  • Bed sores due to unrelieved pressure can develop if elderly individuals spend long periods of time in bed without proper turning and positioning by caregivers;
  • Broken bones and other bodily injures may result from falls if caregivers are not providing the proper assistance with transfers in and out of bed or with toileting;
  • Malnutrition, dehydration or significant weight loss may develop from improper diet or inadequate assistance with feeding at mealtimes; 
  • Poor hygiene, which may lead to skin breakdown or infection, can result from caregivers not changing soiled diapers frequently enough;   
  • Overmedicating an elderly individual can cause unnecessary physical and mental decline;
  • Unexplained injuries or bruises may be the result of rough handling or physical abuse by caregivers.
